That's a legitimate argument and a good point.

Perhaps through such redefinition, the term has come to take on a broader meaning now (I think) among the general populace to refer to results-oriented judging. BY that definition, putting up folks with the intent to reverse Roe v. Wade (for example) could be seen as "activist".

However, I think that part of the blame for this lies with some conservatives (including GOP politicians) who scream "judicial activism" every time a court overturns a a statute or government action that they like.

P.S. Nothing wrong with raising the criticism now if they are right. (It not necessarily contradictory to initially say: "Don't do it!" and then to later say: "Since you did it, don't screw it up!")
