No, Earle is clearly trying to ride this harpooned whale into bigger office. He's doing exaclty what Delay would have done in his shoes. Live by the sword...
Tom Delay is learning that its hard to cover your own ass when you spend 24 hrs of every day looking for other people’s asses to fuck. People like Rove and Delay spend so much time on offense that they can’t afford even the slightest fuck up. There’s a new crop of these scumbags emerging every year, and every one of them thinks he’ll be the first to be able to fuck everyone without payback. Sooner or later, they all slip somewhere, and the list of enemies swarms in to give them a lube-free screwing. So, you’re right, this is partisan... but it also happens to be perfect justice.

The indictment is - unfortunately - weak with regard to Delay. No allegations of Delay himself performing an overt act in furtherance of the conspiracy:
