He went around calling everyone communist and socialists when he was the biggest defender of Tobacco Subsidies in the Senate. The Tobacco policy of the Federal government would make the Politburo proud. The height of hypocracy.

I met him a few times when I worked on the hill. In person he was really nice.

Whatever. The Slippery Slope argument is the lamest argument ever and the NRA uses it incessantly. Makes me sick.

I don't know where we are on this topic, but the exclusionary rules was the lamest idea ever. Pure stupidity. One of the worst moves the Supreme Court ever made.

While I agree that it's a bizarre decision in a lot of ways, I think the court forced itself into a corner by eliminating other ways of redressing constitutional violations. What good is a constitutional prohibition on an invasion of privacy (an improper search and seizure, for example) without some penalty for a violation of that right? If the court won't mess with sovereign immunity, then the government can't really be held accountable to the constitution, can it? And what good is a constitution that a Government can ignore?

So they latched on to the only remedy left.

But to fix the problem, I think we have to fix sovereign immunity.

(Sorry if this is repetitive, but I think the train of thought had gotten buried before).

i suspect that Rehnquist would not have flinched to get rid of the exlusionary rule, on the basis that an action in tort would sound, even if sovereign immunity could be invoked.

There may come a time when a majority of the Supreme Court are willing to let the 4th and 5th amendments become dead letters, much as the 9th has become.

Call me naive, but the government doesn't scare me that much. It is private companys that have the information that scares me. It is the fact that EDS has tracked every purchase I have ever made and knows my spending habits better than myself.

My NRA friends say that it is good to have an armed citizenry in case the government becomes autocratic. First of all, I just don't see our country turning into a dictatorship. The citizenry is not armed in Western Europe and they still have their rights. Second of all, if our government decides to start abusing our rights, a Smith and Wesson ain't going to be much good against the 101st Airborne Division. When Janet Reno and the ATF show up at my door, I am coming out with my hands up.

What does scare me is these militias or drug gangs getting a hold of an AK 47 and blowing my head off. That is what I fear.

Why are you afraid of Janet Reno? If she comes to your door, she'll likely be driving a pickup truck, and she won't have the ATF with her. Perhaps you mean Alberto "Torquemada" Gonzales?

Actually, given the myriad of ways to go, that wouldn't be so bad. Quick, relatively painless. Not that I wouldn't want to have a say in the timing, though.
